Grocery Workers “Cleanup” Bill

On September 21, 2015, California Governor Jerry Brown signed “clean up” legislation (A.B. 897) to address an omission in recently enacted A.B. 359. Assembly Bill 359, which goes into effect on January 1, 2016, will, upon a change in control of a grocery establishment, require an incumbent grocery employer to prepare a list of specified eligible grocery workers for a successor grocery employer and would require the successor grocery employer to hire from this list during a 90-day transition period. Assembly Bill 359 defines a “grocery establishment” to mean a retail store in this state that is over 15,000 square feet in size and that sells primarily household foodstuffs for offsite consumption, as specified.

Assembly Bill 897 amends the definition of “grocery establishment” to exclude a retail store that has ceased operations for six months or more.

Employment Protections for National Guard Members

On August 12, 2015, California Governor Jerry Brown signed legislation amending state law regarding employment protections for members of the National Guard. Existing California law provides protections for members of the National Guard ordered into active state service by the Governor of California or active federal service by the President of the United States for emergency purposes, and for reservists called to active duty.

This bill extends the above protections to members of the National Guard of other states, who are employed by a private employer in California, that are called to military service by their respective governors or by the President of the United States.

The law goes into effect on January 1, 2016.
